TERMS AND CONDITIONS

CELEBRATION CAKES/CUPCAKES

By placing an order with Actually Good, you are agreeing to the following terms and conditions:

ACCESSING OUR WEBSITE

Access to our website is subject to our discretion. We reserve the right to withdraw access or amend our services at any time, without any notice. We will not be liable if for any reason our website is not available. 

(1) PRODUCT

1.1 All our cakes and cupcakes are handmade, meaning each will be unique.  Any photos, illustrations and/or descriptions are for guidance only. We do not create replicas of any other baker’s designs. However, we gladly take inspiration from other cakes and make it our own. You can send us any photos of cakes that you’d like us to use as inspiration on the order form. Please note that we cannot promise exact matches on colour, fondant toppers, personalisation, etc. However, we will do everything we can to make sure you get your perfect cake design.

1.2 Depending on your selected design, some of our cakes and cupcakes contain non-edible items such as bamboo sticks, toys, and acrylic toppers. It is your responsibility to remove these before serving your cake.

1.3 Our cakes and cupcakes should be kept on a flat surface in a cool and dry place, away from direct sunlight. You may keep your cake in the fridge, but this isn’t necessary (unless it’s a hot day.) An ideal storage place for a standard cake is the garage, utility, or somewhere similar.

1.4 Cakes with fresh fruit filling will need to be kept in the fridge and consumed within two days.

1.5 All other cakes and cupcakes should ideally be eaten within three to four days or kept in the freezer for up to a month. 

(2) FOOD ALLERGIES

2.1 Our products are not suitable for any allergy sufferers, due to possible cross-contamination. We do not accept any liability for any damage to your health or any distress inflicted on you by the consumption of such products. 

(3) ORDERING

3.1 Your order is only confirmed once we have received your deposit and you have received an order confirmation from us. We reserve the right to reject any order, prior to confirmation.

3.2 Our prices are liable to change at any time. This will not affect orders where we have already collected the deposit and/or final payment.

(4) OFFERS AND PROMOTIONS

4.1 Actually Good reserves the right to withdraw offers and/or promotions at any time when it is deemed that the offer and/or promotion is being abused. 

(5) DEPOSITS

5.1 To confirm your celebration cake or cupcake order, you must pay a 50% deposit of the total pricing amount. Your order will not be confirmed until we have received your deposit.
5.2 The final payment is due no less than 72 hours before the date of delivery or collection. A reminder email will be sent 7 days before your cake is due to be delivered or collected. If we have not received the final payment after the 72-hour window, we reserve the right to cancel your order. 
5.3 If you order within less than 3 weeks of the required date, full payment is required upon booking.
5.4 All deposits are non-refundable. If you require to change the delivery or collection date of your cake, your deposit may be transferred at our discretion (and depending on availability.) 

(6) PHOTOGRAPHY

6.1 We reserve the right to use any photographs and videos we take of your cake and/or cupcakes for any use.

(7) COLLECTION/DELIVERY

7.1 Upon collection or delivery, you will be asked to sign to verify that your cake is in good condition and is undamaged. By signing, you also acknowledge that Actually Good does not take any responsibility for any damage that may occur once it has been handed to the customer. Additionally, once you have accepted and signed for your cake, Actually Good will not be liable should you believe that there are problems with the cake design. If you are unsatisfied, please let us know before signing and we can see what we can do.
7.2 If you’ve chosen home delivery, your cake and/or cupcakes will be delivered to the address entered upon ordering. We cannot accept any liability for a failed delivery due to an incorrect address. Please check your address before placing your order. If you’d like to change your delivery address, please contact us ASAP and we’ll amend it for you.

(8) TRANSPORTING YOUR CAKE

8.1 Please make sure to always keep the cake level and hold the cake from the bottom.
8.2 If you are collecting your cake from our home bakery, place the cake box in the passenger footwell for the safest transportation. DO NOT transport your cake in the car on the passenger’s lap. A full guide to transporting your cake safely will be provided once your order has been confirmed. It is up to the customer to read and follow these instructions to make sure the cake is transported correctly.
8.3 Once a cake has left our care, Actually Good cannot be held liable for any damage that may occur during transportation.
8.4 If you are transporting your cake beyond your home address, we recommend that you refrigerate your cake before travelling with it for at least 3 hours beforehand. This ensures the buttercream is firmly set. It is recommended that you again follow the steps in the ‘transporting your cake’ guide.

(9) CANCELLATION POLICY

9.1 If you decide to cancel your order, your deposit is non-refundable and only transferable subject to our discretion and availability. If you have already paid the full amount, you will be refunded 50% but your deposit will be retained. If you cancel within 72 hours of your selected date, the full payment will be retained; considerations will be made in the case of an emergency or if your event has been cancelled.  
9.2 It is rare that we should have to cancel your order, however, Actually Good is a one-person team and in the case of serious illness, might be unable to create your cake. In this case, we will give you as much notice as possible and you will be provided with a full refund, including your 50% deposit. 
9.3 If you’d like to change your order details or date, please let us know ASAP. We will do our best to accommodate changes, however, they may not always be possible. 

(10) COMPLAINTS

10.1 Due to the perishable nature of the goods, we cannot process returns.

10.2 If you have a complaint about your order, please let us know within 24 hours of receiving your product. Please provide photographs to help explain why you are unhappy. Any refunds will be issued at our discretion. Note: occasionally, during the courier transit, some cosmetic damage may occur to your bakes. Although they may not look as pretty as when we sent them out, we promise that they’ll still taste incredible! As a small business, we appreciate your understanding.

10.3 If you have received an incorrect order, or you’re missing an item, we will credit or refund your purchase. If the products are damaged beyond consumption, i.e., the cake jars have smashed, please retain the damaged goods and all packaging until advised to dispose of it. Refunds will be made at our discretion for the full price you paid, or we will credit you with a replacement for the exact order.

(11) CHANGES IN TERMS AND CONDITIONS

11.1 Actually Good reserves the right to modify these terms at any time without prior notice. Any updates and/or changes to these terms will be considered effective immediately at the time of posting on our website.  

These terms and conditions do not affect your statutory rights as a consumer.
